Welcome to SleepUp Mattress ("SleepUp," "we," "us," or "our"), operated under SLEEPUP MATTRESS, located at No:20 Loordhu Garden, Vadaperumbakkam, Chennai - 600060. These Terms and Conditions ("Terms") govern your access to and use of the website sleepupmattress.com (the "Site") and the purchase of any products listed on it ("Products").
By accessing or using the Site, placing an order, or otherwise interacting with us (including via phone, WhatsApp, or our sales team), you agree to be bound by these Terms. If you do not agree, please discontinue use of the Site.
1. About Us
SleepUp Mattress is a factory-direct mattress brand manufacturing and selling mattresses (Ortho Plus, Ortho Lite, Euro Premium, and Knight) directly to consumers across India, without intermediary retail markups.
2. Eligibility
By using this Site or placing an order, you confirm that you are at least 18 years of age and competent to enter into a legally binding contract under the Indian Contract Act, 1872. Orders placed on behalf of a company or organization may only be made by an authorized representative of that entity.
3. Products and Pricing
- All Products displayed on the Site are subject to availability.
- Prices listed are in Indian Rupees (Rs.) and are inclusive of applicable GST unless otherwise stated.
- We reserve the right to modify prices, discontinue Products, or update Product specifications at any time, without prior notice and at our sole discretion. The price applicable to your order is the price confirmed to you at the time of order confirmation (by our telecalling team, SMS, or WhatsApp).
- Product images are for representation purposes; minor variations in color, texture, or finish may occur due to photography or display settings.
- Offers, discounts, and promotional pricing (including free delivery, trial periods, or warranty terms) are valid only as stated on the Product page or at the time of purchase and may be modified or withdrawn at our discretion for future orders.
4. Orders and Payment
- Orders may be placed via the Site, telephone, WhatsApp, or through our sales/telecalling team. Orders placed verbally over phone or via WhatsApp with our telecalling team are equally valid and binding as orders placed on the Site, once confirmed by us.
- We accept payments via Cash on Delivery (COD), online prepaid methods (UPI, cards, net banking), and other modes as made available at checkout or communicated by our team.
- An order is confirmed only upon our acknowledgment (via call, SMS, WhatsApp, or email). We reserve the right to cancel or refuse any order due to stock unavailability, pricing errors, suspected fraud, or serviceability issues at the delivery location.
- For COD orders, full payment is due in cash at the time of delivery unless otherwise agreed. We reserve the right to refuse COD as a payment option for any order at our discretion (for example, high-value orders, repeated refusal history, or unverified addresses) and may request a prepaid token amount instead.
- Repeated refusal to accept a confirmed COD order, or unavailability to receive delivery without prior intimation, may result in the order being cancelled and future COD orders from the same customer being declined.
5. Shipping and Delivery
- We offer free delivery within our serviceable areas, as communicated at the time of order.
- Estimated delivery timelines will be shared at the time of order confirmation; these are estimates and not guaranteed delivery dates.
- Delays beyond our control: We are not liable for delays caused by events outside our reasonable control, including but not limited to transport strikes, weather conditions, courier/logistics partner delays, or natural disasters ("Force Majeure"). We will inform you as soon as reasonably possible of any such delay and take steps to minimize its impact.
- If delivery is delayed by more than 10 days beyond the originally communicated date for reasons within our control, you may contact us to cancel the order and receive a full refund (for prepaid orders) or simply decline the COD delivery.
- Title and ownership of the Product passes to you only upon successful delivery.
- It is your responsibility to ensure someone is available to receive the delivery and that the delivery address and access (for example, stairs, lift availability) are accurately communicated at the time of order. If redelivery is required due to an incorrect address, unavailability at the scheduled time, or inaccessible location, additional redelivery/transport charges may apply, which will be communicated before rescheduling.
- If you wish to reschedule a confirmed delivery, please inform us at least 24 hours in advance where possible.
6. Warranty
Our Products come with a 10-year warranty against manufacturing defects, subject to the specific warranty terms applicable to each Product model as communicated at the time of sale. Warranty does not cover:
- Physical damage, cuts, burns, stains, or improper use.
- Use on an unsuitable or damaged base/cot.
- Normal wear and tear, including foam softening over time within tolerance.
- Products used for commercial purposes.

7. 100-Night Trial, Returns and Exchanges
Our 100-Night Trial, Return, and Exchange policy (including gift deduction, pickup charges, and refund timelines) is governed by our dedicated Return and Refund Policy (sleepupmattress.com/return-refund), which forms part of these Terms by reference. Please refer to that page for complete details before initiating a return or exchange request.
8. Intellectual Property
All content on this Site and across our official social media channels, including the SleepUp name, logo, product images, brand and promotional videos, graphics, and written content, is the property of SleepUp Mattress and is protected under applicable Indian copyright and trademark laws. You may not copy, reproduce, distribute, mirror, or use any such content for commercial purposes without our prior written consent. Unauthorized use, including by competitors or resellers, may result in legal action.
9. Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms.
- Use bots, scrapers, or automated tools to extract data from the Site.
- Attempt to gain unauthorized access to our systems, accounts, or data.
- Post or transmit any harmful, defamatory, or misleading content via the Site.
We reserve the right to restrict or terminate access to the Site for any user found in violation of these Terms.
10. Limitation of Liability
To the maximum extent permitted by law, SleepUp Mattress shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Site or the purchase/use of our Products, except as expressly provided under our Warranty or Return and Refund Policy. Our total liability in connection with any order shall not exceed the amount paid by you for that order.
11. Indemnification
You agree to indemnify and hold SleepUp Mattress, its employees, and representatives harmless from any claims, damages, or expenses (including legal fees) arising out of your breach of these Terms or misuse of the Site.
12. Privacy
Any personal information you provide to us (name, phone number, address, etc.) is collected and used in accordance with our Privacy Policy (sleepupmattress.com/privacy-policy-5), which is incorporated into these Terms by reference.
13. Amendments
We reserve the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting to the Site. Your continued use of the Site or future orders after such changes constitutes acceptance of the revised Terms. We recommend reviewing this page periodically.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

Return (Refund) — How it Works

Mattress ₹10000 − ₹1700 (gift deduction) − ₹499 (pickup) = ₹7801 refund
Mattress ₹10000 − ₹1700 (gift deduction) − ₹499 (pickup) = ₹7801 refund
Exchange — Simple & Smooth
- ✔ One-time exchange within 100 nights (firmness/size).
- ✔ Exchange shipping (TN): ₹999 (pickup + re-delivery).
- ✔ Outside TN: actual courier rates (quote shared before scheduling).
- ✔ 100-night clock does not reset; remaining nights continue from original delivery date.
What's NOT Covered
- ✔ Physical damage: cuts, burns, holes, pet damage, indentations.
- ✔ Hygiene issues: heavy stains, persistent odour, spills, mould/mildew, infestations.
- ✔ Protector not used from Day 1 leading to visible soiling.
- ✔ Improper base: broken/sagging cots, uneven slats (>3"), damp floor, folding/rolling.
- ✔ Commercial use — residential only.
- ✔ Custom sizes, special orders, demo units — trial not applicable.
Refund Timeline
- ✔ Pickup scheduling (TN): 24–72 hours.
- ✔ Courier transit to Chennai hub: 5–10 days.
- ✔ QC at hub: 24–48 hours.
- ✔ Prepaid: refund within 7 business days after QC.
- ✔ COD: refund via bank/UPI within 7 business days after QC.
- ✔ Total from pickup to money received: ~15–20 days.
